Mediation is a great way to resolve almost any dispute.
The Concept
The concept is simple. It is based on the idea that when two or more people have a disagreement, there is a possibility of a win/win resolution.
Mediation provides a safe, confidential, and efficient way for two or more people to come together and work through a conflict with the aid of a trained neutral third-party.
The third-party – a mediator – is there to offer clarification, maintain a safe environment, and get the parties working together to achieve a shared positive outcome.
The Mediation Process
- The mediator explains the process and establishes guidelines and ground rules.
- Everyone is given a chance to speak without being interrupted.
- Then the mediator will open the floor to a collaborative discussion with all the parties. At this point, the mediator will look for common ground.
- The Agreement: All parties work together with the help of the mediator to come up with a resolution that is deemed fair to everyone.
- A “Consent Agreement” is drafted that outlines the final resolution of the mediation. After reading it back to the parties, the mediator will ask if everyone agrees to the conditions of the agreement. If everyone is in accordance, all parties involved, including the mediator, will be asked to sign it.
What Not to Expect
- Mediators do not take sides: Mediators are there to get all parties communicating with one another, and see to it that everyone feels they are being treated equally.
- We do not make decisions: The outcome is up to you and the other parties. The mediator cannot tell you what to do.
- A big bill: Mediation is not expensive.
